NEW DELHI:  The government is yet to define whether or not cryptocurrencies are goods or providers earlier than it brings these currencies beneath goods and providers tax (GST) ambit, as per govt sources. 

The clarification comes after experiences said that the GST Council is mulling to tax cryptos at 28%.

 Currently, a 30% tax is levied on positive factors made via switch of those currencies and different digital belongings. Meanwhile, 1% TDS will even apply on crypto transfers from July 1, 2022. In addition, 18% tax is levied on providers offered by crypto exchanges.  

After the government imposed tax on crypto transfers at 30% from April 1, it has not taken any stance on its regulation. Recently, finance minister Nirmala Sitharaman, in Washington, raised issues about cash laundering and unlawful funding together with terrorism through cryptos. She mentioned India would take a thoughtful determination on crypto regulation

 As per sources, if GST is imposed on digital currencies then it is going to be potential and never retrospective. 
 “The government has not commented on legality of cryptos. However, mulling of upper GST and introduction of TDS beneath earnings tax together with capital achieve provision appears to be aimed toward deterring investor participation within the sector.
